Event - Terms and Conditions of Sale

Canva US, Inc. and Canva Pty Ltd (“Canva”) is hosting Canva Create 2024 at Hollywood Park, located at 1001 South Stadium Drive, Inglewood, CA 90301, on 23 May 2024 (“Event”).

Please read these Terms and Conditions (“Terms”) carefully before purchasing a ticket to the Event. You should read these Terms in conjunction with the Code of Conduct(opens in a new tab or window). By purchasing a ticket, you agree to be bound by these Terms and you acknowledge and agree to Canva’s Privacy Policy(opens in a new tab or window).

These Terms relate both to the sale of tickets and attendance at the Event. These Terms apply to both the original purchaser and any subsequent ticketholders (“you”).

Ticket Classes

1. Canva will make available two classes of tickets for the Event (“Tickets”):

a. Virtual tickets do not require financial payment, and include access to a virtual stream of the keynote session and a selection of additional sessions (to be determined by Canva); and

b. In Person tickets cost $175 USD (a limited number of tickets will be available in an early release at $95) and includes access to the in-person event, including the full day of programming and after-party.

2. You must register for Tickets using the relevant form, which will be made available on canva.com, or such other website or application that is used in connection with the Event.

3. These Terms apply to all In Person Tickets, regardless of whether a fee was paid for the ticket.

Conditions of entry

1. You must be over 21 years of age to purchase an In Person ticket and attend the Event.

2. You may be denied entry into, or removed from, the Event for breaching the Code of Conduct, or for any other undesirable or offensive behaviour, including behaviour that is objectionable to Canva or adversely affecting the enjoyment of the Event by others.

3. You may be required to submit to a search of your person and/or possessions before entering the event.

4. You acknowledge that Canva is not responsible for any lost, stolen or damaged property. Security of your personal property is the sole responsibility of you.

5. If you arrive late, you may not be admitted until a suitable break in the Event.

6. You may not be permitted to use, cameras or other photographic or recording equipment (including mobile phones) at the Event.

7. By attending the event, you and each attendee in your group acknowledge and agree that you each may be filmed, photographed and/or recorded and you each give permission to the Canva to use your image, likeness and voice obtained at the event in all media throughout the world for any purpose and without any compensation.

8. You may leave the venue during the Event, but you must display your Canva Create badge to be granted re-entry. If you do not have your Canva Create badge, we may decline your request to re-enter the venue.

9. Canva will not be responsible or liable for any loss, damage or injury however caused nor any consequential loss or damage, arising from your attendance at the Event, and you assume all risk associated with your attendance at the Event.

Authenticity and validity of Tickets

Entry to Event may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from Canva.

Refund policy

1. Canva will not offer refunds as a result of a change of mind, a change in your personal circumstances or due to external factors such as, for example, adverse weather. Canva will only provide a refund on request if an event is cancelled, rescheduled or significantly relocated by Canva (and you cannot or do not wish to attend the rescheduled or relocated event), or to the extent otherwise required by law.

2. If an event is cancelled, rescheduled or significantly relocated, all liability is limited to the amount for which the ticket was purchased (including any fees or charges unless otherwise notified at time of purchase). Proof of purchase may be required for any refund or exchange. Unless required by law, Canva will not be liable for any other losses incurred by you as a result of the cancellation, rescheduling or relocation of an event, including any travel and accommodation expenses.

No re-sale or promotional use

Tickets to the Event may not be re-sold, on-supplied or transferred for commercial, consumer or promotional purposes, bundled with other goods or services, or used for promotional purposes without Canva’s prior written consent.

Food and drink

1. You must be over the age of majority to order or consume alcohol at the Event. Canva is committed to the responsible service of alcohol, and will enforce the checking of proof of age identification by service providers. You must carry valid proof of age identification at the Event and present it if requested.

2. Intoxicated attendees may be refused service.

3. Outside food or drinks are not allowed on the premises and you may not bring them to the Event.

Variations to Event

Canva reserves the right to add, withdraw, reschedule or substitute sessions and/or vary the advertised program in any way, including varying seating arrangements.

Variations to the Terms

1. Canva reserves the right to make changes to these Terms at any time by posting the changes on canva.com, or such other website or application that is used in connection with the Event.

2. You will be subject to the Terms made available on the relevant website or application at the time of the Event.

Force Majeure

1. Neither party will be in breach of these Terms, nor have any liability to the other party, if it is prevented from complying with its obligations by reason of any act, event or circumstance beyond the reasonable control of the affected party (“Force Majeure Event”).

2. If a Force Majeure Event prevents Canva from being able to host the Event, then Canva’s entire liability to you is to refund the ticket cost you have paid to attend the Event. Canva will not be liable to compensate you for any additional losses, including but not limited to airfares or accommodation.

Severability

If any of these clauses in these Terms are deemed invalid, void, or for any reason unenforceable, that term will be deemed severable and will not affect the validity and enforceability of any remaining clauses.
