Terms & Conditions for Canva Community Celebration Contest

TERMS & CONDITIONS

Terms for the Canva Community Celebration Contest (“Contest”) are contained below:


1. Eligibility: This Contest is open only to persons who are 18 years old or older as of the date of entry. A person may submit an entry to the Contest on behalf of another person (Nominee) or a team of two or more (Team) provided that the Nominee and each member of the Team also meets these eligibility requirements. Employees of Canva Pty Ltd (“Canva”), its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (together, “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Contest. This Contest is not open to any individual in a jurisdiction where the Contest or the individual entering the Contest would be prohibited by law.

2. Agreement to Terms: By submitting an Entry to the Contest, the entrant (“You”) agrees to be fully unconditionally bound by these Terms. You also represent and warrant that You, your Nominee or each member of your Team meet the eligibility requirements and that the Contest and You entering the Contest is not prohibited in Your or Your nominee’s jurisdiction. In addition, You agree to accept the decisions of Canva as final and binding as it relates to the Contest.

3. Contest Period: Entries will be accepted online between 10 August 2022 at 8:00pm PDT and 18 August 2022 at 11:59pm PDT ("Contest Period"). Entries must be received before the end of the Contest Period.

4. How to Enter:

(a) To participate in the Contest, you must:

(i) tell us in a maximum of 500 words the Canva success story you think deserves recognition (whether your own or your Nominee’s) in one of the following categories:

(1) Inspiring Individuals: An individual who has used Canva to empower others and create positive impact;

(2) Impactful Teams: A Team that has used Canva to reach a milestone and collectively achieve a mission;

(3) Incredible Innovators: An individual or Team that has used Canva to design unique inventions or experiences; and

(ii) submit your entry, in English, and a copy of the Canva design(s) related to the success story through the Canva Community Celebration submission form linked here: https://canva-create.com/community-awards (“Entry”). You may also submit a video no longer than 60 seconds to support you submission (optional), (“Competition Guidelines”)

(b) Only one entry is allowed per person or Team, per category. If your Entry is an individual success story and You or Your Nominee are also a member of a Team Entry, either the Team Entry or the individual Entry will be eligible to win an award, but not both.

(c) Entries must comply with the brief listed in the Competition Guidelines. Entries that contain sexual content, violence or gore, or promote discrimination against any individual or group, or that otherwise contain content that in the view of Canva is inappropriate, will not be accepted.

(d) The Entry must fulfill all Contest requirements, as specified in these terms, to be eligible to win a prize.

(e) Entries that are incomplete or do not adhere to the terms may be disqualified at the sole discretion of Canva.

(f) If You use fraudulent methods or otherwise attempt to circumvent these terms, your submission may be removed from eligibility at the sole discretion of Canva.

5. Prizes:

(a) At least one (1) individual and one (1) Team will be selected by a team of Canva-appointed panelists (“Canva Panel”) based on the criteria set out in section 6 of these Terms (“Winners”).

(b) Subject to 5(c), the Winners will receive the following prizes:

(i) Exclusive Canva Award;

(ii) Showcase of their winning Entry at the Canva Create event;

(iii) Canva merchandise;

(iv) $500 USD (five hundred United States dollar) donation to a cause of the Winner’s choice (subject to Canva’s approval); and

(v) Half a day design mentoring with a Canva team member

(c) If a chosen Winner is a Team, the prizes will be awarded to the team as a whole and not to individual team members. Access to the design mentoring session and merchandise will be provided for up to five (5) team members only. For example, if a team of ten (10) people is declared the Winner, only five (5) people will be entitled to attend the mentoring session.

(d) All specifics of the prizes shall be solely determined by Canva. No substitution of prizes or transfer/assignment of prizes to others or request for the cash equivalent by Winner is permitted. If for any reason there are logistical or other issues with providing a prize, Canva may at its sole discretion provide a substitute prize of equivalent or lower value.

(e) Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the Winner.

Acceptance of the prizes by the Winner constitutes:

(i) permission for Canva to use the Winner’s name(s), likeness, and Entry for purposes of advertising and trade without further compensation; and

(ii) an acknowledgement that the Winner may be requested to participate in Promotional activities relating to the Contest, including, without limitation, being recorded, photographed, filmed or interviewed for purposes of advertising and trade without further compensation.

6. Winners Selection and Notification:

(a) The Canva Panel will select the Winners based on the creativity, storytelling, entertainment value, and originality demonstrated in the Entries.

(b) If an Entry has been submitted for a Nominee, the Winner will be the Nominee, who will be required to confirm their acceptance of these terms and conditions.

(c) The Contest is a game of skill, chance has no part in determining the Winners.

(d) The Winners will be notified via the email entered in the Entry submission form.

(e) To the extent permitted by law, Canva shall have no liability for:

(i) any Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information;

(ii) any Winner’s inability to receive or participate in any component of the prize.

(f) Winners will be notified within 2 weeks of the end of the Contest Period.

(g) If a Winner cannot be contacted, is ineligible, fails to claim the prize within forty-eight (48) hours from the time notification was sent, or fails to timely return a completed and executed declaration and release or non-disclosure agreement (if required), the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in this Contest is conditioned upon compliance with any and all federal, state, and local laws and regulations.

(h) ANY VIOLATION OF THESE OFFICIAL TERMS BY WINNER, AT CANVA’S SOLE DISCRETION, WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CONTEST, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

7. Rights Granted by You:

By submitting an Entry, You:

(a) understand and consent to Canva, anyone acting on behalf of Canva, and Canva’s licensees, successors, and assigns, having the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your Entry, the Winner’s name, and statements about the Contest, for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

(b) represent and warrant that you have the right to submit the Entry, the Entry is an original work of authorship by You, your Team or your Nominee, and does not violate any third party’s proprietary or intellectual property rights. If your Entry infringes upon the intellectual property right of another, You, your Team or your nominee will be disqualified at the sole discretion of Canva. If the content of your Entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Canva from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Canva may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

9. Canva Rights:

Canva reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest in the event Canva becomes aware or reasonably suspects there to be virus, bug, non-authorized human intervention, fraud, or other cause beyond Canva’s control that could affect the administration, security, fairness, or proper conduct of the Contest. In such a case, Canva may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Canva. Canva reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Terms. Canva has the right, in its sole discretion, to maintain the integrity of the Contest, to reasonably void entries, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by the Terms; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such an attempt be made, Canva reserves the right to seek damages to the fullest extent permitted by law. By participating in this Contest, You acknowledge that this Contest is in no way sponsored, endorsed or administered by, or associated with Facebook or any other social media site.

10. Liability: By submitting an Entry, to the extent permitted by law, You agree to release and hold harmless Canva and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether or not caused by negligence, from: (i) Your participation in the Contest and/or Your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error in the administration of the Contest or the processing of entries. You may have certain non-excludable rights or remedies under law. These Terms are subject to any non-excludable right or remedy You have under law.

12. Privacy Policy: Canva collects information from You (such as your name and details you provide in entering the Contest) in order to conduct the Contest and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry to the Contest is conditional on providing this information. This section should be read in conjunction with Canva’s Privacy Policy which explains how Canva collects, stores, and uses personal information https://www.canva.com/policies/privacy-policy/, which also sets out your data protection rights, including access and correction and how you may complain or raise a query about our handling of your information. Depending on Your location, Your information may be disclosed by Canva outside your jurisdiction as contemplated in these Terms. Please see Canva's Privacy Policy for further details. Entrants should direct any request to access, update or correct information to Canva at privacy@canva.com.
