Canva for Education Additional Terms

These Canva for Education Additional Terms supplement Canva's Terms of Use if you meet the Canva for Education Eligibility Guidelines and are using Canva for Education (“Educational Institution”).

  1. The section entitled ‘Your Indemnity Obligations’ apply only to the extent permitted by applicable law.
  2. The section entitled “Limitation of Liability” shall be replaced with the following: IN NO EVENT SHALL EITHER PARTY BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, LOSSES, OR EXPENSES (INCLUDING BUT NOT LIMITED TO BUSINESS INTERRUPTION, LOST BUSINESS, OR LOST PROFITS) EVEN IF IT HAS BEEN ADVISED OF THEIR POSSIBLE EXISTENCE AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY. IN NO EVENT SHALL CANVA’S AGGREGATE CUMULATIVE LIABILITY UNDER THESE TERMS (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY IN TORT OR BY STATUTE OR OTHERWISE) EXCEED $100.
  3. The section entitled “Governing Law and Jurisdiction” is deleted and replaced with the following “These Terms will be governed by and construed in accordance with the laws of the state, province, or territory in which the Educational Institution is located.”
  4. To the extent applicable, you will obtain any necessary parent or guardian consent for a student to use Canva for Education prior to inviting a student to the Canva classroom in accordance with applicable laws, including without limitation the Children’s Online Privacy Protection Act (“COPPA”).
  5. You will only use, and only permit your students to use, Canva for Education (and all Licensed Content incorporated therein) for non-commercial, educational purposes.
  6. Canva for Education may only be used by an Educational Institution’s students, staff, and faculty.
  7. Students may only be invited to use Canva for Education by a Teacher and may use Canva for Education so long as they are a student of the Educational Institution and under the supervision of a Teacher.
  8. For purposes of the Canva for Education Additional Terms, a “Teacher” means an individual who is working for an Educational Institution and whose primary role is teaching its enrolled students, or as otherwise defined in the Eligibility Guidelines.
  9. Any reference to or use of the For the purposes of Canva for Education, “Student Data” shall be limited to the information required to establish and operate a user’s Canva account, such as name, email, password, school enrollment, teacher name, and course enrollment, and does not include “User Content” as defined in Terms of Use.
  10. By creating a Canva for Education account, you confirm that you have read, understood and agree to our Data Processing Addendum in full, and that the Data Processing Addendum shall be incorporated into this Agreement to the extent Personal Data subject to the Applicable Data Laws (as defined in the Data Processing Addendum) is processed in your use of the Service. In the event of any conflict between the Terms and the Data Processing Addendum, the Data Processing Addendum shall prevail. This section shall not apply if you or your organization has entered into a separate agreement with Canva pertaining to the processing of personal data.
  11. Any reference to or use of the term “Student Data” or a similar term in any agreement between Canva and Educational Institution shall mean the information required to establish and operate a student’s Canva account (such as name, email, password, school enrollment, teacher name, and course enrollment) and does not include “User Content” as defined in Terms of Use.
